Terms of Service

In plain words — what you can and can't do in heybird, the terms on which we provide the Service, and how we handle disputes.

General

These Terms of Service (the "Terms") govern your use of the heybird.app service (the "Service", "we").

For any questions related to these Terms: hello@heybird.app.

By using the Service, you agree to these Terms and to the Privacy Policy. If you do not agree with them, please do not use the Service.

About the Service

HeyBird is a service for getting to know the birds of your city: a species catalog, photos, sounds, and a personal collection of observations. The Service is provided "as is", in its current form and scope.

The core functionality of the Service is free. Paid features may appear in the future — their terms will be described separately before any payment.

We may change, extend, or discontinue individual features of the Service at any time. We will try to give advance notice of significant changes that affect your account.

Account

Some features require an account. By registering, you confirm that:

  • you can independently give consent to the processing of personal data under applicable law, and if you have not reached that age, you use the Service only with the involvement of a parent or legal guardian;
  • the email address you provide belongs to you;
  • you are responsible for keeping access to your account and to the mailbox used to sign in secure.

One person may have one account. You can delete your account at any time — in your account settings or by writing to us.

Acceptable use

When using the Service, you agree not to:

  • violate applicable law;
  • attempt to gain unauthorized access to the Service, its data, or other users' accounts;
  • interfere with the Service's operation: circumvent rate limits, create excessive load, or bulk-download content by automated means without our consent;
  • impersonate others;
  • post content in your profile (name, bio, avatar) that is unlawful, offensive, misleading, or infringes third-party rights;
  • use the Service to send spam or for other malicious activity.

We may restrict or terminate access to the Service if these Terms are breached. For serious breaches — without prior notice.

Your content

By posting content in the Service (avatar, name, profile bio), you:

  • retain all rights to it;
  • grant us a non-exclusive license to store, process, and display it as part of operating the Service;
  • confirm that you hold the rights to the content you post.

The species marks in your collection are personal in nature and are not scientific observation records.

We may remove content that breaches these Terms.

Service content and rights to it

The Service's content includes:

  • bird photos and audio recordings — belong to their authors and are used under open licenses (Creative Commons and similar) or by arrangement with the authors; attribution is shown next to the materials. You may not use these materials outside the Service without complying with the terms of the relevant license or the author's permission;
  • texts, species descriptions, design and interface elements, program code, and the Service's database — belong to the Service. Copying, reproducing, or distributing them without our consent is not permitted, except where expressly allowed by law;
  • scientific data on species distribution — based on open sources (eBird, GBIF, and others) and used in accordance with their terms.

The HeyBird name and logo may not be used without our consent.

Disclaimer of warranties

The Service is provided "as is" and "as available". We do not guarantee:

  • uninterrupted and error-free operation of the Service;
  • the completeness and absolute accuracy of information about bird species, their distribution, and identification features.

The information in the Service is for educational purposes. It is not intended for decisions requiring professional accuracy (scientific research, interaction with wild animals, or identifying dangerous situations).

Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for indirect damages, lost profits, loss of data, or other harm arising in connection with the use of or inability to use the Service.

Nothing in these Terms limits liability that cannot be limited by law.

Links to third-party resources

The Service may contain links to third-party sites (Wikipedia, eBird, and others). We do not control their content and are not responsible for it.

Termination

You may stop using the Service and delete your account at any time. We may suspend or discontinue the Service as a whole, giving users reasonable advance notice where possible.

Sections 6–8 survive termination of these Terms.

Changes to these Terms

We may update these Terms. The current version is always available at heybird.app/en/terms. A Russian version is also available. We will notify you of significant changes through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated version.

Dispute resolution

We aim to resolve any issues directly: if you have a complaint, write to hello@heybird.app — we will respond within 30 days and try to settle the matter through negotiation.

Miscellaneous

If any provision of these Terms is found invalid, the remaining provisions stay in force. These Terms constitute the entire agreement between you and the Service regarding the use of heybird.app.
